Welcome to Final Ecommerce! These Terms of Service ("Terms") govern your use of the Final Ecommerce A/B testing application ("App") for Shopify. By installing and using our App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service
Final Ecommerce provides A/B testing tools for Shopify store owners to optimize their ecommerce performance. The App allows you to create, manage, and analyze A/B tests on your Shopify store.

To use the App, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account

4. Subscription and Payment
a. Subscription Plans: The App is offered on a subscription basis with different pricing plans. Details of the subscription plans and pricing are available on our website.
b. Billing: By subscribing to the App, you agree to pay all applicable fees in accordance with the selected subscription plan. Subscription fees are billed in advance on a monthly or annual basis, as per the chosen plan.
c. Refunds: All fees are non-refundable, except as required by law or as otherwise stated in our refund policy.
5. User Conduct
You agree to use the App in accordance with these Terms and all applicable laws and regulations. You agree not to:
a. Use the App for any unlawful purpose or to promote any illegal activities.
b. Interfere with or disrupt the operation of the App.
c. Attempt to gain unauthorized access to any part of the App or related systems.
d. Use the App to transmit any harmful or malicious code.

To the maximum extent permitted by law, Final Ecommerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
a. Your use of or inability to use the App.
b. Any unauthorized access to or use of our servers and/or any personal information stored therein.
c. Any interruption or cessation of transmission to or from the App.
9. Indemnification
You agree to indemnify and hold harmless Final Ecommerce, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or your violation of these Terms.

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of the Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
